冯超,资深知识产权和数据保护律师,泰和泰(北京)律师事务所高级合伙人,国际业务部主任,数字经济法律中心总负责人。冯律师毕业于中国外交学院,获文学士学位及国际法学硕士学位,后毕业于美国杜克大学法学院,获得法学硕士学位,系该校首位获得知识产权法文凭的硕士研究生。冯律师以中、英、日文作为工作语言。
Feng Charles, a veteran intellectual property and data protection lawyer, is a Senior Partner at Tahota Law Firm (Beijing Office). He serves as the Head of the International Business Department and the General Lead of the Digital Economy Law Center. Mr. Feng graduated from China Foreign Affairs University, earning a Bachelor of Arts degree and a Master of Laws (LL.M.) in International Law. He furthered his legal studies at Duke University School of Law in the United States, where he obtained a Master of Laws (LL.M.) and was the first LL.M. graduate in the law school's history to receive a Diploma in Intellectual Property Law. Mr. Feng works fluently in Chinese, English, and Japanese.

冯律师在知识产权相关的争议性和非争议性案件、与知识产权有关的反垄断案件以及网络安全和数据保护方面具有丰富经验。过去二十年里,冯律师代理了大量知识产权申请和确权案件。此外,其处理过的诉讼案件包括专利和商标确权及侵权诉讼案件、知识产权合同纠纷案件、立体商标确权案件、驰名商标认定案件、著作权侵权案件、商业秘密侵权案件、反不正当竞争以及反垄断案件。冯律师还经常参与知识产权交易合同的起草、谈判和执行。此外,冯律师还经常为企业提供网络安全、数据合规方面的法律服务。
冯律师曾就职于日本贸易振兴机构、美国贝克麦坚时律师事务所、金杜律师事务所、万慧达律师事务所以及天达共和律师事务所担任合伙人和律师。在日本贸易振兴机构工作期间,其参与了日本特许厅与国家知识产权局和国家商标局的合作机制的建立以及日本商会知识产权工作小组JETRO/IPG的建立。冯律师曾参加2014年国家版权局著作权法修改项目的调研,并就著作权法修改提供意见。2020年冯律师代表日本特许厅和日本贸易振兴机构就著作权法修改内容向全国人大常委会提供修改意见。
作为具有丰富经验的中国知识产权实务专家,冯律师还积极参与国内外与知识产权相关的组织活动并在业界具有一定声望。冯律师担任最高人民法院案例指导基地专家、以及中国版权协会、中国知识产权法学研究会、欧盟商会、美国律师协会、日本贸易振兴机构的常务理事、理事或专家,并担任北京律师协会反不正当竞争和反垄断委员会委员和国际商标协会中国商标局运营委员会委员。
冯律师代理的案件还曾入选最高人民法院2013年50大知识产权典型案例。2019年,冯律师代理知产诉讼案件获得北京市某法院首例临时禁令。
Mr. Feng possesses extensive experience in both contentious and non-contentious intellectual property matters, IP-related antitrust cases, as well as cybersecurity and data protection. Over the past two decades, he has represented clients in a substantial number of intellectual property prosecution and registration cases. His litigation portfolio further includes patent and trademark validity and infringement lawsuits, IP contract disputes, three-dimensional trademark registration cases, well-known trademark recognition cases, copyright infringement cases, trade secret infringement cases, anti-unfair competition, and antitrust litigation. Mr. Feng also regularly engages in the drafting, negotiation, and execution of intellectual property transaction agreements. Additionally, he frequently provides clients with legal services pertaining to cybersecurity and data compliance.
Mr. Feng has previously held positions as a partner and lawyer at the Japan External Trade Organization (JETRO), the international law firm Baker McKenzie, King & Wood Mallesons, Wan Hui Da Law Firm, and Tian Da & Partners. During his tenure at JETRO, he contributed to the establishment of cooperative mechanisms between the Japan Patent Office and China's National Intellectual Property Administration and Trademark Office, as well as to the formation of the JETRO/IPG working group under the Japanese Chamber of Commerce. In 2014, Mr. Feng participated in research for the National Copyright Administration's Copyright Law amendment project and provided recommendations on the proposed revisions. In 2020, he represented the Japan Patent Office and JETRO in submitting formal comments on the draft Copyright Law amendments to the Standing Committee of the National People's Congress.
As a seasoned expert in Chinese intellectual property practice, Mr. Feng actively participates in domestic and international IP-related organizations and enjoys a strong reputation within the industry. He serves as an expert for the Supreme People's Court Case Guidance Base, and holds positions as Standing Director, Council Member, or Expert for organizations including the China Copyright Association, the China Intellectual Property Law Society, the European Union Chamber of Commerce in China, the American Bar Association, and the Japan External Trade Organization. He is also a member of the Anti-Unfair Competition and Anti-Monopoly Committee of the Beijing Lawyers Association and a member of the China Trademark Office Operations Committee of the International Trademark Association.
Cases represented by Mr. Feng have been selected among the "Top 50 Typical Intellectual Property Cases" by the Supreme People's Court in 2013. In 2019, he secured one of the first preliminary injunctions in an intellectual property litigation case at a Beijing court.
