Terese Foged has more than 20 years of experience as a lawyer specialising in copyright and intellectual property law in a broad sense and in the interface between media and entertainment. She focuses on copyright in the digital world and the issues raised by new technology, market situations and consumer behaviour.
She advises on general media law and works with digital media, design, furniture and text, where questions often arise about plagiarism, the exploitation of rights and the protection of press publications. She also advises on marketing law, trademarks and other intellectual property rights.
Terese has extensive experience drafting, negotiating and advising on rights agreements concerning assignment, acquisition, licensing, distribution and exploitation of rights, including exceptions, crediting and ownership. She also advises on idea generation, strategic planning of rights exploitation and rights clearing. Her advice covers clearance models, including collective licensing and extended collective licensing schemes, cooperation with other rights holders as well as determination of remuneration. She has, among other things, advised numerous Danish and non-Danish enterprises on the use and dissemination of audiovisual material. The use of AI in work creation and infringements are highly topical issues in which Terese is increasingly involved.
Terese contributes to the implementation of the latest EU legislation in the field of intellectual property law and to the application of Danish rules in relation to international tech companies. In the event of foreign investments in Danish rights, her advice includes the assessment of exploitation potential and the determination of return for the rights holders and securing remuneration.
In brief, Terese's copyright work covers a wide range of issues, including sector regulation such as streaming services' payment of cultural contributions to the Danish State.
