A major manufacturing firm listed on the Frankfurt Stock Exchange (“the Group”): advising the group on strategies to pursue potential legal actions against STARK in Thailand based on the claims under the share purchase agreement entered into by the Group as the sellers and STARK as the buyer (“SPA”). Currently, STARK appears to be experiencing financial difficulties, and there is a high likelihood that STARK may enter into either insolvency or rehabilitation proceedings. Therefore, the Group is prepared to pursue all potential legal actions to recover its debts under those proceedings, including the enforcement of foreign arbitral awards. The STARK matter was notably the most discussed topic in Thailand’s stock market during the latter half of 2023. This is due to its association with the manipulation of financial statements and stock prices, and fraud, which has caused severe damage to a broad segment of investors in the Thai stock market.
Creditors: acting for numerous creditors of a prominent regional airline based in Southeast Asia in relation to its debt restructuring, including a major aviation services company.
French corporate and investment bank: representing a French corporate and investment bank in filing an application against a major international airline for repayment of outstanding financing debts under business rehabilitation proceedings in the bankruptcy court. The total debt required to be restructured under these proceedings is approximately USD 10.7 billion.
