Practice Areas
Spencer specialises in employment, human rights, EU and commercial law. He acts for both corporate clients and individuals at first instance and appellate levels. He is particularly well known for injunction proceedings in the High Court (concerning employee competition, restraints of trade and confidentiality), for complex jurisdictional disputes and for disability discrimination cases. Examples of recent cases include: an appeal considering the need for a diagnosis of a deemed disabilities under the Equality Act 2010, an appeal considering whether an international organisation had legal personality for the purposes of domestic employment law, cases considering the effect of Article 10 ECHR both on the territorial jurisdiction of an English tribunal and the interpretation of domestic legislation, and injunction proceedings concerning the alleged theft of confidential information. In Unison v Lord Chancellor Spencer appeared for the Equality and Human Rights Commission in the Supreme Court judicial review of the government’s decision to impose fees in the employment tribunal (with Mark Whitcombe and led by Michael Ford KC).
