Recent highlights include: R (ASLEF) v Secretary of State for Business and Trade [2023] EWHC 1781 (Admin) (quashing the statutory repeal of the prohibition on using agency workers to cover for strikers); Miles v DVSA [2023] IRLR 630 (whether belief about Covid-19 risks to health unreasonable in determining disability); Burn v Alder Hey Children’s NHS Foundation Trust [2022] ICR 492 (whether there is an implied term of fairness in the conduct of disciplinary proceedings in an employment contract); Page v NHS Trust Development Authority [2021] ICR 941 (first appellate case on the distinction between manifestation of belief and its consequences); Chief Constable of Devon and Cornwall v Town (appellate consideration of the distinction between pregnancy discrimination and health and safety) and PF v DBS [2020] UKUT 256 (AAC) (test case on the scope of the Upper Tribunal’s power to interfere with DBS’ findings of fact on appeal).
