In 2025, Attorney Shi successfully represented clients in dozens of highly influential cases. Notably, in the retrial case regarding a contract dispute between Xinjiang Energy (Group) Co., Ltd. and Yan’an Tengtian Petroleum Drilling Engineering Technology Service Co., Ltd., which had been adjudicated by two levels of courts—the Urumqi Intermediate People’s Court and the Higher People’s Court of Xinjiang Uygur Autonomous Region—Attorney Shi led her team to conduct an in-depth review of case materials, re-examine the facts and redefine the legal relationships. Her efforts ultimately led the Supreme People’s Court to rule to retry the case and reverse the original judgment, reducing the client’s losses by nearly 100 million yuan.

Work Highlights
1.Retrial Case of Contract Dispute between Xinjiang Energy (Group) Petroleum & Natural Gas Co., Ltd. and a Yan’an Petroleum Drilling Engineering Technology Service Co., Ltd.
After two rounds of trials by the Urumqi Intermediate People’s Court and the Higher People’s Court of Xinjiang Uygur Autonomous Region, and when the client’s mining right was subject to auction proceedings, our team conducted an in-depth review of case materials, re-examined the case facts and redefined the legal relationships. These efforts ultimately led the Supreme People’s Court to rule to retry the case and reverse the original judgment, reducing the client’s losses by nearly 100 million yuan.
2.Dispute over Shareholder Capital Contribution between Shaanxi Yonglong Investment Co., Ltd. and Baoji Xingshengda Engineering Construction Co., Ltd., et al.
The core disputes in this case centered on whether the registration of mining rights and the equity registration arising from exploration right contributions constitute separate legal relationships, as well as the identification of relevant parties in the event of conflicts between them. The case also involved a number of complex legal issues, including the justiciability of capital reduction and the possibility of succession relationships between existing legal persons.
We sorted out in detail the changes in coal exploration policies and mining rights registration administration systems over historical periods, as well as the restructuring and joint venture backgrounds of state-owned enterprises during specific historical stages. We also collected a series of related case files from the Supreme People's Court, Xi'an Intermediate People's Court and other judicial authorities. Ultimately, we achieved a complete victory whereby all claims of the opposing party were dismissed.
3.Retrial Case of Contract Dispute between Shaanxi Henghe Real Estate Development Co., Ltd. and Hu Mou
The dispute fundamentally arose from adjustments to national education policies, which resulted in the uniform conversion of supporting kindergartens in commercial real estate from private operation to public welfare kindergartens. The business model of investing in and operating supporting kindergartens under the original education policy became unsustainable, triggering a series of civil litigation disputes between developers and kindergarten operators. This case is of typical significance in Shaanxi Province. The essence of the breach of contract dispute lies in how to assess and allocate commercial risks caused by policy changes, and it serves as a valuable reference for the handling of numerous similar cases.
Following our retention as counsel for the retrial, we successfully petitioned the Shaanxi Higher People's Court to retry the case despite unfavorable judgments in both the first and second instance proceedings.
4.Retrial Case of Contract Dispute between Baoxin International Financial Leasing Co., Ltd. and Jiangyou City Hospital of Traditional Chinese Medicine
The telemedicine cases involved hundreds of local hospitals and dozens of financial leasing institutions across more than a dozen provinces, autonomous regions, and municipalities directly under the Central Government. The total amount in dispute in the series of cases exceeded 10 billion yuan. Higher people's courts in various regions issued inconsistent rulings, including dismissing the claims, suspending proceedings, and upholding the claims of financial leasing companies. Hospitals and financial leasing companies from all over the country successively filed applications for retrial with the Supreme People's Court, making these cases highly influential.
We represented Jiangyou City Hospital of Traditional Chinese Medicine in filing an application for retrial with the Supreme People's Court. After deliberation by the Professional Committee for Civil and Administrative Trials, the Supreme People's Court issued a ruling ordering the Shaanxi Higher People's Court to retry the case.
5.Retrial Case of Administrative Registration Dispute between Miao Chengliang, Shenmu Municipal Administration for Market Regulation and the Sixth Villager Group of Lijiapan Village, Shenmu City
The focus of the dispute in this case was the legality of the administrative act regarding the appointment and removal of the person-in-charge of the coal mine, which in fact involved a dispute over the control of the coal mine. In both the first-instance and second-instance judgments, the court held that the coal mine was a partnership enterprise and revoked the registration alteration act of the administrative authority. As the legal representative for the Villager Group, we filed an application for retrial as a third party and obtained the order of retrial by the Shaanxi Higher People's Court.
