Robert Unikel is partner and head of the Chicago and Midwest Intellectual Property practice at Paul Hastings. Robert has a diverse practice that includes litigating patent, trade secret, and trademark cases in a variety of industries, including digital media distribution, targeted advertising, cloud storage, consumer electronics, financial products and services, consumer products and brands, medical devices, and auto systems and parts.
Robert’s extensive experience includes first-chairing patent and trade secret cases involving varied products such as, a digital distribution platform for mobile "apps," on-device AI models, targeted advertisement systems, vascular stents and related surgical instruments among many others. Robert is also quite familiar with diverse business methods for tracking promotional mailings, implementing consumer rewards programs, configuring products through an electronic interface, and automatically executing securities and derivatives trades.
Robert has unique experience in successfully defending against claims of false patent marking under 35 U.S.C. 292. He has managed disputes involving various well-known trademarks and non-traditional source indicators while also handling appeals to the Federal Circuit Court of Appeals and to the United States Supreme Court. Further, he regularly counsels businesses and individuals on intellectual property development, protection, and licensing strategies.
