Kenneth Herzinger is global co-chair of the Paul Hastings Investigations & White Collar Defense practice and is a former Securities and Exchange Commission Enforcement Division attorney. His practice focuses on federal and state regulatory investigations and enforcement actions, securities litigation, and global and domestic internal investigations.
Mr. Herzinger has more than 25 years of experience defending companies, broker-dealers, investment advisors and individuals in regulatory investigations and litigation by the SEC, DOJ, State Attorneys General and self-regulatory organizations concerning a wide range of matters including disclosure fraud claims, accounting and financial statement fraud, insider trading, FCPA violations, BSA/AML violations, cybersecurity, blockchain, cryptocurrency, and Sarbanes-Oxley Act and Dodd-Frank Act whistleblower retaliation claims.
A seasoned securities litigator, Mr. Herzinger has defended officers, directors and companies in dozens of high-stakes securities class actions, derivative actions and M&A litigation. He has tried cases in federal and state court and in arbitration proceedings and was a member of the trial team that obtained a jury defense verdict in one of only several securities class action jury trials in the country to be tried to verdict since the passage of the Private Securities Litigation Reform Act in 1995.
Mr. Herzinger has also conducted over 50 global and domestic internal investigations for public and private companies and audit committees regarding a myriad of issues.
