Luca Lucarini is a Toronto-based associate in our Privacy and Cybersecurity and Litigation and Dispute Resolution groups.

Luca provides risk management and regulatory compliance advice to clients on privacy, data security, anti-spam (CASL) and consumer protection matters. He has particular expertise in managing comprehensive, organization-wide privacy and data security assessments and working with clients to achieve compliance with their private and health-sector privacy obligations. A firm disbeliever in the “one-size-fits-all” approach, Luca calibrates his advice to each of his clients’ individual risk tolerance and operational posture. He is adept with consumer-facing terms of use and privacy notices, as well as internal governance materials. Luca regularly drafts and negotiates the privacy and data security elements of various technology-related agreements, with a particular expertise in data sharing and outsourced data processing agreements involving the processing of both personal and de-identified data.

Luca’s clients also rely on him for sound, timely and pragmatic advice on regulatory issues that arise in the course of their day-to-day activities, including in the context of employee privacy, public-sector access-to-information requests, and private-sector data subject requests and complaints. Luca assists clients in addressing data incidents by advising on investigation and remediation issues, as well as notification and reporting obligations. Luca also provides due diligence and risk assessment for M&A and other commercial transactions.

Luca also maintains a litigation practice in which he acts for clients in privacy and data security-related class actions, as well as health law and access-to-information proceedings. He has acted for clients before the Ontario Superior Court, the Information and Privacy Commissioner of Ontario, the Information and Privacy Commissioner of British Columbia, the College of Registered Nurses of Alberta, and before referees in confidential commercial dispute resolution processes.

Luca’s clients benefit from his project management skills and responsiveness, which he honed in his previous career as a post-production coordinator. In that capacity, Luca designed and implemented post-production systems for network television and studio film productions, including several in South America, Europe and Asia. Before transitioning to the law, Luca also directed, shot and edited several feature-length documentaries on a range of topics (including intellectual property law issues). Prior to joining Dentons, Luca articled with the Information and Privacy Commissioner of Ontario, where he assisted with investigations and reviews under Ontario’s public-sector privacy legislation and access-to-information judicial review proceedings.
