Jen Fernandez is a leader in Sidley’s international trade practice and heads the firm’s export controls practice. Jen counsels clients on export controls, sanctions, and broader geopolitical and national security risks affecting global business operations, supply chains, technology transfers, and cross-border investments. She advises multinational companies, private equity sponsors, and financial institutions on complex U.S. national security and international trade matters, including the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), economic sanctions administered by the Office of Foreign Assets Control (OFAC), U.S. anti-boycott regulations, Information and Communications Technology and Services (ICTS) supply chain restrictions, reviews before the Committee on Foreign Investment in the United States (CFIUS), and the Outbound Investment Security Program.
Her practice includes product classifications, licensing, compliance program development, internal investigations and enforcement matters, as well as managing the extraterritorial reach of U.S. national security laws. She also advises on the national security aspects of cross-border transactions and investments, including trade due diligence, CFIUS risk analysis and filings, outbound investment restrictions, and transaction structuring. Jen represents clients across jurisdictions and in a broad range of industries, with a recent focus on biotechnology, fintech, data centers, artificial intelligence, semiconductors and related equipment, MedTech, defense, and other highly regulated industries.
