Practice Areas

Jane joined Clyde & Co in 1974 and has been a partner for over 35 years. She specialises in dispute resolution in all its forms; she has extensive experience of Arbitration (whether by contractual agreement with reference to established Rules or organisations or on an ad hoc basis) and Litigation whether in the UK or internationally. For the last two decades Jane has also been prominent in the area of Alternative Dispute Resolution, principally mediation, both as mediator and as client representative/advocate. She has further been engaged by clients in the role of "Settlement Counsel" where existing representatives have been unable to extract clients from protracted and complex arbitration/litigation and a more commercial approach is needed.

Her main areas of expertise are reinsurance and insurance (marine, non-marine and aviation) but she now also deals with major international contractual disputes arising out of trading relationships, construction projects and finance matters. Jane has dealt with a wide range of other disputes, frequently of a complex, cross-border or multi-party nature, including those originating in the sectors of financial services, business contracts, employment, lender liability, professional liability, marine/aviation contractual disputes, partnership/shareholder/joint venture issues and transportation.

Experience

• Advising London insurers on major reinsurance dispute arising out of 9/11

• Acting for insurers in a large broker dispute involving commission payments litigated in the High Court and subsequently resolved by mediation

• Recent High Court and Court of Appeal judgments, favourable to reinsurer clients, obtained in relation to fidelity losses (both jurisdictional dispute and claim on merits)

• Representing cedants in quota share reinsurance dispute for USD 30 million involving brokers' E&O - resolved without litigation but with full recovery of claim, interest and costs

• As mediator, resolved series of disputes in respect of alleged pension mis-selling arising under professional indemnity insurance cover

• Multi-million dollar dispute between insurers and blue chip insured involving commodity losses suffered in the former Soviet Union - resolved without resort to litigation or the instruction by either side of other lawyers

• Series of professional indemnity claims totalling GBP 12 million arising out of lender disputes - resolved, as mediator, through managed mediation
