Drew Gardiner counsels clients on strategies for maximizing insurance coverage and represents policyholders in complex insurance coverage disputes.
Drew is one of the nation’s leading experts on D&O (Directors and Officers) liability coverage, annually advising more than 250 clients on D&O related issues in connection with corporate transactions, restructurings, securities litigation, and government investigations. Drew has also prosecuted coverage claims involving a variety of first- and third-party policies, including commercial general liability, D&O, E&O (Errors and Omissions), property, and environmental impairment policies.
Drew was a guiding force behind the revision to the Delaware Corporations Code to allow companies to use captive insurers to meet their Side A D&O insurance needs, and since that development has drafted D&O policies for use by several clients’ captive insurers.
Drew is co-lead counsel in Montrose Chemical Corporation of California’s coverage litigation against over 40 excess insurers, in which Montrose seeks coverage for more than US$250 million of environmental liabilities. The long-running case has led to numerous decisions by the California Supreme Court and Courts of Appeal, and is currently in the appellate courts on another issue of national import. Drew was recently elected to the prestigious American College of Coverage Counsel.
