Paul Burbank provides tailored commercial and regulatory advice across technology, media and telecommunications (TMT) industries. The bulk of Paul’s work involves supporting client legal teams with practical, business-focused advice for the launch and adoption of new technology and telecommunications systems, services and products.
Paul’s commercial work is Information Technology (IT) focused, assisting institutional private and public-sector clients on technology and IT commercial contracts and transactions. The matters on which he works include enterprise-wide outsourcing arrangements, cloud and SaaS arrangements, software licensing, managed services, and other forms of technology acquisition and implementation. He works directly with clients to review, negotiate and draft master agreements and all other documentation for business-to-business commercial deals. He also reviews and drafts Terms of Service and related policies and warranties in business-to-consumer contexts, where he brings to bear his experience on consumer protection laws and regulations.
In his regulatory work, Paul helps clients navigate complex legal frameworks applicable to telecommunications and technology by advising on an array of licensing, corporate ownership and control, certification, enforcement and dispute resolution matters. He provides strategic advice to telecommunications service providers, broadcasters, radio equipment and hardware vendors, satellite service and IoT/M2M connectivity providers, app developers, as well as social media and digital services companies, among others. He also assists clients on international telecommunications matters, including regulatory reviews for multifaceted physical infrastructure projects such as international terrestrial and submarine fiber-optic cable networks. He acts for these clients in a range of formal and informal proceedings before the Canadian Radio-television and Telecommunications Commission (CRTC), Innovation, Science and Economic Development Canada (ISED) and other federal departments and agencies.
Paul collaborates with the firm’s team of TMT professionals on cybersecurity, privacy, metadata, lawful interception and market access issues, as well as telecommunications-based marketing practices and anti-spam laws (CASL).
