David is an accomplished trial attorney with a national practice focused on high-stakes labor and employment disputes as well as complex commercial litigation. Over the course of his career, he has handled more than 90 jury trials, 20 bench trials and a wide array of arbitrations, earning a reputation for his courtroom skill. His clients include major players in the entertainment, hospitality, and food and beverage sectors.
He has extensive experience defending clients in a broad spectrum of employment law matters, including cases involving the Fair Labor Standards Act, Title VII, the Family and Medical Leave Act, the Americans with Disabilities Act, whistleblower protections, and other federal and state civil rights and labor statutes. Drawing on his background as a U.S. Air Force veteran, David frequently addresses legal issues under the Uniformed Services Employment and Reemployment Rights Act (USERRA). He is adept at defeating class certification and has litigated labor and employment cases in courts throughout the country, with a particular focus on representing businesses in class and collective action lawsuits.
David’s litigation experience also extends to representing insurance companies in matters involving coverage disputes, corporate espionage, contingent liability, fraud and allegations of bad faith. Notably, he secured a favorable verdict in a high-stakes insurance class action trial. In addition to his trial work, David regularly advises clients on strategies to manage risk and avoid litigation, helping them proactively reduce their legal exposure.
Beyond his legal practice, David has contributed to the academic community as an Adjunct Professor of Labor and Employment Law at both the University of Alabama School of Law and Mercer University’s Walter F. George School of Law. He is a published author for the Defense Research Institute, has been cited in The National Law Journal, and his cross-examination skills have been highlighted on ABC’s “20/20.” David is also active in the legal community, having moderated seminars for the National Bar Association, including programs focused on the dynamics between in-house and outside counsel.
