Global head of Skadden's Labor and Employment Law Group, David E. Schwartz advises clients on a full spectrum of employment-related issues. He regularly represents clients before state and federal administrative agencies and courts, as well as in arbitration proceedings, in defense of retaliation, discrimination, wage/hour, breach of contract and fraud claims, including potential class actions. Mr. Schwartz also counsels clients in cases concerning the enforcement of restrictive covenants and breaches of fiduciary duties. His non-litigation experience includes advising clients in connection with various AI and ESG-related issues: conducting internal investigations; implementing non-harassment policies; creating compensation programs; negotiating employment/separation agreements as well as collective bargaining agreements, and; implementing reduction-in-force plans. Mr. Schwartz also represents clients in connection with business transactions, including restructurings, involving the development and implementation of strategies to retain key executives and professionals, among other things.
