Career

Brendan Quigley is a former federal prosecutor in the Southern District of New York, a U.S. Marine combat veteran, and an experienced first-chair trial lawyer. He helps business executives, boards of directors, and companies navigate both government enforcement matters and commercial disputes. He has been described by client and peers as “uniquely calm and persuasive” and as providing “pragmatic, sound advice and prompt responses to questions.”

Before joining Baker Botts, Brendan served for seven years as an Assistant United States Attorney in the Southern District of New York, investigating and prosecuting cases in two of the Office’s most elite sections, the Securities and Commodities Fraud Unit and the Terrorism and International Narcotics Unit. As an AUSA, Brendan gained extensive first-chair trial and appellate experience, trying 12 cases to verdict, including numerous complex multi-week trials, and briefing and/or arguing 10 appeals before the Second Circuit. He also acquired deep substantive experience in both the securities and commodities laws and in matters involving national security and classified information.

Government and Internal Investigations/Enforcement: Drawing on his experience as an AUSA, Brendan's investigations practice focuses on securities and commodities enforcement; international anti-corruption, sanctions, and export control risks; and the False Claims Act. He has assisted clients in both the boardroom and the courtroom. For example, he has helped companies and investors assess compliance and enforcement risks associated with new business ventures or potential transactions; conducted internal, non-public investigations on behalf of companies, boards, and special committees in response to whistleblower allegations and government inquiries; and engaged in public, hotly contested litigation against the government in criminal and civil enforcement matters in court.

Commercial Disputes: Drawing on his experience as a first-chair trial lawyer, Brendan also represents clients as both plaintiffs and defendants in commercial disputes. These matters often involve complex transactions and/or allegations of fraud or corruption. In 2023, for example, Brendan prevailed at trial in the Delaware Court of Chancery in a dispute among shareholders of a closely held corporation. In 2022, he was a key member of a team that prevailed in an intercreditor indenture litigation in federal bankruptcy court. In 2021, he successfully defeated a securities fraud lawsuit against a fintech company in New York state court.

Earlier in his legal career, Brendan spent a year clerking for the Honorable Joseph F. Bianco, then a U.S. District Judge in the Eastern District of New York, now of the Second Circuit.

Between 2001 and 2005, Brendan served as an officer in the U.S. Marine Corps. He completed two tours of combat duty in Iraq and was honorably discharged with the rank of Captain.
