Alberto is a member of FERRERE’s Intellectual Property team. He provides legal assessment and legal defense to Bolivian and foreign companies in intellectual property and copyright proceedings, supporting all kind of clients from local startups to multinational corporations.
His practice includes filing and defending trademarks and patents with successful results in IP litigation such as oppositions, cancellation of trademarks, annulment procedures and infringement actions. He has vast experience developing custom made strategies for each client, representing them in actions before the Bolivian Intellectual Property Office (SENAPI) and judicial reviews before the Bolivian Supreme Court.
He also works with artists, creators and entertainment and media companies protecting their copyrights, transfer of copyright ownership, defense and transfer of image rights as well as protection of Tv Formats. He also writes technology transfer agreements, know-how transfer agreements, license agreements, trademark coexistence agreements and distribution agreements.
In his corporate practice, he provides legal services such as set up corporations, draft articles of association and incorporate subsidiaries of foreign companies. He assesses companies in the compliance of corporate rules and obligations in order to avoid sanctions due to infringement of corporate duties; he has also been invited to give lectures and to train in-house personnel on the subject. He successfully represents companies in administrative proceedings conducted by the corporate regulator (AEMP). He also has experience drafting supply agreements, commercial agency agreements and franchise agreements.
He also has vast experience in Data Protection regulation as he worked for a Spanish company that provides assessment for the compliance of data protection rules and for the lawful use of image rights. In Bolivia, he assists local companies by drafting their conditions of use, privacy policy and cookies policy displayed in their websites, accordingly to European standards and the European General Data Protection Regulation.
Before joining the firm, Alberto worked in an important Bolivian law firm as head of its Intellectual Property team and managing trademark portfolios of leading companies in their fields, as well as assisting clients in civil law, corporate law and administrative proceedings before regulators.
Member of the Inter-American Association of Intellectual Property (ASIPI), where he participates actively on its committees.
