Practising in the corporate restructuring, insolvency and financial services areas, Tom Cumming is a partner and leader of Gowling WLG’s restructuring and insolvency practice in Calgary.
Tom focuses on the restructuring, insolvency and liquidation of large and mid-market corporate debtors in proceedings under the Companies' Creditors Arrangement Act, the Bankruptcy and Insolvency Act, the federal and provincial Business Corporations legislation, the Winding-Up and Restructuring Act and the Judicature Act.
He has significant experience with restructuring, liquidation and financing in sectors including the up-stream and mid-stream oil & natural gas production and service industry, commercial real estate, manufacturing, retail, mining, agricultural and technology industries.
Tom has represented a variety of stakeholders in restructuring and receivership proceedings including private and public debtors, private equity and institutional lenders, purchasers and receivers, monitors and trustees. He regularly represents clients before Alberta courts and was co-counsel to the receiver at the SCC in the Orphan Well Association v. Grant Thornton Ltd., which dealt with the priority of regulatory obligations and the ability of receivers to disclaim environmentally contaminated assets.
