Practice Areas
Robert is an expert in employment law, in particular in cases which raise public law and human rights issues. Examples of his employment cases include NUPFC v Certification Officer (Court of Appeal) and Gilham v MOJ (Supreme Court). He is currently representing the Secretary of State for Education in ongoing litigation concerning the status and rights of foster carers. He also represents and advises the Judicial Appointments Commission and the Ministry of Justice in respect of claims brought by and against judges. He was also recently successful, in both the Tribunal and EAT, in defending the DWP in a gender-critical belief discrimination claim (Mackereth).
In addition, Robert regularly appears in complex discrimination, whistleblowing and human rights claims in the Employment Tribunal and EAT, as well as in judicial reviews in the High Court and Upper Tribunal.
Robert has been on the Attorney General’s A Panel of Counsel since 2015. In his role on the panel, Robert represents and advises an extensive range of Government Departments, Agencies and public sector bodies in both employment law and in judicial reviews in other fields. Robert also appears on behalf of Trade Unions and Trade Union funded clients, as well as NHS Trusts. His particular expertise is in public sector workforce issues.
