Emma has a broad practice encompassing all aspects of commercial litigation, arbitration and advisory work. As well as general commercial disputes, Emma has experience of energy, banking and civil fraud disputes, jurisdiction challenges and applications for injunctive relief. Notable cases include: Autonomy Corporation Limited v Lynch and Hussain [2022] EWHC 1178 (Ch) (claims for breach of fiduciary duty, breach of contract and misrepresentation relating to the acquisition of Autonomy by the HP group); Travelport Limited & Ors v Wex [2020] EWHC 2670 (Comm) (expedited preliminary issues trial before the Commercial Court surrounding the proper construction of, and burden of proof in relation to, the definition of a Material Adverse Effect within an SPA); FDIC v Barclays Bank plc & Ors (large-scale litigation brought by the Federal Deposit Insurance Corporation against a number of LIBOR panel banks in relation to alleged USD LIBOR misconduct); CCUK Finance Ltd v Barclays Bank plc [2018] EWHC 304 (Comm) (claim concerning alleged mis-selling of PBP in relation to a portfolio of credit cards); BG Global Energy Ltd v Talisman Sinopec Energy UK Limited [2015] EWHC 110 (Comm) (trial of preliminary issues relating to the proper interpretation of a transportation, processing and operating services agreement).
