Carl Bivens provides excellent service by listening and understanding the client’s position, learning the commercial and technical issues, having experience from prior complex projects, and using a problem-solving approach.

Carl’s practice involves commercial acquisition, disposition, leasing and development of property for energy, datacenter, office, retail, and industrial projects. Carl has assisted clients on the acquisition and ground-up development of datacenters, including creating the form documents for a global, hyperscale technology company for their third-party datacenter developments. Carl has negotiated build-to-suit leases as well as development, service and colocation agreements for datacenter projects globally, with multiple projects completed in the U.S., Chile, Canada, India, Australia, Japan, Germany, and England. Additionally, he has assisted clients on subsea cable landing stations and datacenters associated therewith.

In the energy space, Carl represents developers, utilities, and operators on all aspects of energy transactions, particularly in the solar, wind, battery storage, hydro storage, geothermal, and gas sectors. Carl handles issues with permitting, leasing, acquisition, disposition, and development of energy projects, as well as commercial financing, equity infusion, and tax equity financing.

In addition to his datacenter and energy niche practice, Carl represents clients on office, retail, and industrial permitting, acquisitions, dispositions, development, and leasing.
