Brent has practiced environmental law for over 20 years, focusing his practice on air, water and waste issues. He regularly represents major utilities, industry groups and other businesses throughout the country on issues related to the treatment and storage of coal ash and other wastes, including compliance with EPA’s coal ash rule and defense of enforcement actions and citizen suits alleging non-compliance with state and federal water and waste laws. Brent also regularly advises clients on matters related to the Clean Air Act, including the new source review and regional haze programs. Brent helped achieve a major victory for a client in the Court of Appeals for the Sixth Circuit on the controversial issue of whether the federal Clean Water Act regulates discharges to groundwater, which helped create a further circuit split on the issue and set up review in the United States Supreme Court. Brent also helped obtain summary judgment in a case alleging that the client’s waste management practices were causing an “imminent and substantial endangerment” to human health and the environment. The court found no evidence of any such endangerment and excluded substantial parts of two expert opinions attempting to demonstrate otherwise.
