Career

Tony Martin is the managing shareholder of the Las Vegas office, and is a “hybrid” attorney, providing representation and guidance on both traditional labor and employment related matters to employers on a nationwide basis. With more than 20 years of actual, practical experience in the restaurant and hospitality industry, Tony has substantial experience representing national, regional, and locally owned and operated restaurant, tavern, hotel and casino companies in labor and employment related matters. In addition to providing day-to-day legal advice and counsel to employers around the country, Tony’s practice includes the development of proactive employee relations strategies to maximize employee engagement and satisfaction, as well as minimize the risk and impact of third party disruptions, addressing workforce issues.

Utilizing his prior experience with unions and the NLRB, Tony represents employers in traditional labor law matters, including significant R-Case experience, the creation and implementation of union avoidance programs, including providing training to supervisors/managers, which include best practices to maintaining a union-free environment, the preparation of responses to ULP Charges, conducting of labor arbitrations, and the negotiation and maintenance of collective bargaining agreements.

Tony also regularly defends employers throughout the country in claims including, but not limited to, the defense of wage and hour class actions, as well as suits brought pursuant to Title VII, Americans with Disabilities Act, Family Medical Leave Act, the Age Discrimination in Employment Act before state and federal courts (including corresponding to state law claims and administrative charges before government agencies). Tony also provides guidance on and litigates restrictive covenant matters.

In addition to his continual provision of advice and counsel to employers on all aspects of the employment relationship, Tony’s practice includes the provision of guidance to employers on:

the enhancement and/or development of proactive employee relations and engagement programs;

the preparation of coordinated and collaborative organizational responses to actual and anticipated internal and external disruptions to the workplace (including anticipated local community and nationwide corporate campaigns); and

the review and/or development of inclusion, collaboration, equity and diversity programs.

Tony’s unique experience with crisis management also allows him to provide timely and appropriate guidance and responses to highly sensitive and confidential leadership and employee concerns, incidents of workplace violence, and political and community activism that may occur in the workplace at any time, and reductions in force.

While Tony’s practice focuses on the gaming, hospitality, restaurant, sports, entertainment, tourism, convenience store, and retail industries, he has significant experience providing labor and employment support to the financial services industry, distribution centers, manufacturers and government contractors. Additionally, Tony has prior experience as a stockbroker and financial consultant (held Series 7, 6, 63, and additional licenses), and is a member of the Firm’s Investment Committee. Tony is also part of the Firm’s M&A practice group, primarily from an L&E perspective, assisting clients with pre-transaction analysis and preparation, due diligence, and organizational impact analysis post-transaction.

Tony is a member of UNLV’s Harrah’s College of Hospitality Global Advisory Board, and a member of the Nevada Restaurant Association’s executive and legislative committees. In his role as the firm’s primary liaison to the ACC-SoCal Chapter (Platinum Sponsorship), Tony works closely with the Chapter’s Diversity Committee on many of its annual DEIB programs, including the Chapter’s InSide Diversity and Profiles in Diversity events.

Tony is a frequent speaker at the firm’s national, regional and local programs. He is a founding member of Stay Connected, a free seminar series focusing on significant labor and employment issues. Stay Connected is a partnership of HR and legal professionals dedicated to providing and maintaining a better workplace.
