Christian & Small Partner David Walston leads the firm's Labor and Employment practice group – practicing exclusively in this arena for over 30 years. He regularly defends businesses in claims under Title VII, § 1981, § 1983, ADA, ADEA, and FMLA. With the growth of wage and hour litigation, Walston has spent a large part of his practice defending individual and collective actions under the FLSA. His experience further extends to advising and representing management regarding rights and obligations under the National Labor Relations Act, including response to employee complaints and other concerted activities, union organizational activity, and unfair labor practices charges.
Walston holds an AV Preeminent Peer Review Rating from Martindale-Hubbell and has been recognized by the following organizations: The Best Lawyers in America in the fields of Litigation-Labor & Employment and Employment Law-Management (2011-2020) and "Lawyer of the Year" for Labor & Employment Litigation (2018); by Mid-South Region Super Lawyers in 2019 in the field of Labor & Employment; by Benchmark Litigation as an Alabama "Labor & Employment Star."
