Theodor van Sante is an experienced senior junior specializing in commercial litigation, transactions and advisory work, in particular in the fields of banking and finance, financial services and regulation, insurance and proceeds of crime.
He is frequently instructed in heavy litigation, including in recent years the Allianz v J.D. Williams dispute concerning liabilities for insurance mis-selling, and both the multi-billion pound claims arising out of capital raising undertaken during the financial crisis: in the RBS Rights Issue Litigation and PCP v Barclays. He also undertakes judicial review work, including most recently the judicial review of the FOS in R (Assurant) v FOS.
Theodor also provides expert advice on compliance, enforcement and transactions for regulated firms, as well as being instructed by regulators including for the PRA and FCA on financial services matters, including in relation to challenges to regulatory decisions before the Upper Tribunal, insurance-business transfers and schemes of arrangement. He also is regularly instructed on civil recovery matters under POCA.
