Practice Areas

Nigel has long and extensive experience of handling the full range of employment related disputes. Recent High Court work includes dealing with injunction applications in respect of alleged breaches of restrictive covenants, breaches of the duty of confidentiality and database rights. This has extended to testing the validity of restrictive covenants and database rights at full trial. Recent Employment Tribunal work includes a complicated case of constructive unfair dismissal with knock on consequences for a related High Court claim for monies due under a share purchase agreement. He has defended race discrimination claims , including harassment and victimisation claims in the aviation sector and brought and defended disability discrimination claims. He has an ongoing case challenging the lawfulness of the medical examination process for specialty doctors and whether it is indirectly discriminatory on the grounds of ethnic origin and/or nationality. Nigel also dealt with the first case in the Employment Tribunal to test the extent of positive action measures which could be taken under S159 of the Equality Act 2010 [Furlong v Chief Constable of the Cheshire Police].Nigel was also involved in The Employment Appeal Tribunal in a case which addressed the proper approach in law to contributory fault [European Toughened Glass (Manchester) Ltd v Heire UKEAT/0215/19/OO]. He is approachable and friendly which helps to put clients at ease.
