Kevin Hart is a seasoned litigator who defends companies and individuals facing government investigations, criminal prosecutions, and complex civil litigations.
As a former senior official at the Antitrust Division of the U.S. Department of Justice, Kevin draws on nearly 25 years of government experience to provide strategic counsel and vigorous advocacy across the full spectrum of antitrust matters, including investigations, prosecutions, jury trials, leniency applications, grand jury proceedings, and compliance programs. As the Division's former "go to" prosecutor entrusted with supervising and litigating its most complex and high-profile matters, Kevin understands government enforcers' priorities and playbook, and he uses that insight to craft effective defense strategies for clients in civil and criminal proceedings.
Kevin also counsels clients on compliance, helping them develop robust programs to identify and mitigate risk before issues arise. When disputes do emerge, he brings his trial-tested experience to bear in government criminal and civil antitrust investigations and litigations, negotiating resolutions when appropriate.
Kevin also has significant investigations and white collar experience having served as Senior Counsel at the Securities and Exchange Commission (SEC) and as a Special Assistant United States Attorney, where he focused on securities fraud violations. Having successfully led dozens of complex white collar trials and investigations, Kevin is well positioned to provide practical counseling and to assist clients in assessing and mitigating potential risk.
Kevin is a frequent speaker on antitrust, investigations, and litigation issues. He currently serves as chair of the Criminal Antitrust Subcommittee for the ABA's Litigation Section and vice chair of the Antitrust Law Section's Cartel and Criminal Practice Committee for the New York State Bar Association. He also has served as a non-governmental advisor (NGA) for the International Competition Network (ICN).
