David Kiernan is an accomplished trial lawyer who has litigated antitrust and unfair business practice cases in federal and state courts across the country. He has represented clients in the tech, energy, health care, consumer brand manufacturing, digital advertising, real estate, and railroad industries and routinely counsels clients on antitrust and competition law issues. David has a successful track record defending against claims of price fixing, market allocations, group boycott, tying, bundling, price tampering, unlawful discounting, and monopolization among other areas. David also has significant experience in refusal to deal, "no-poach," and IP antitrust cases. His recent matters include obtaining a complete defense verdict after a four week jury trial in which the plaintiff class alleged that Sutter Health had restrained competition by allegedly forcing insurers to include certain hospitals in their provider networks and forbidding them from steering patients to other hospitals, obtaining summary judgment for an oil refiner in a price fixing case, and obtaining dismissal of an antitrust class action against a significant tech company alleging tying and monopolization. David is the Partner-in-Charge of Jones Day’s Northern California offices and Head of Litigation of Jones Day’s San Francisco office.
