Career

Juanita is a partner in the Firm’s Intellectual Property and Technology, and Privacy and Cybersecurity practice groups. Main international legal directories have recognized her for her experience and knowledge in both TMT and IP. She has over 20 years of experience managing complex IP, Privacy, and Consumer Protection portfolios for major multinational and local companies focused on technology, retail, e-commerce, BPO, mass consumption, and transportation.

In addition to local recognition, Juanita’s experience led her to be the Regional Leader of Dentons Latin America TMT Practice Group, leading regional efforts to provide an effective and practical assessment for clients operating in different jurisdictions.

Juanita combines extensive legal knowledge with a comprehensive understanding of the TMT market and the regulatory and political factors that can influence business decisions. Specifically in technology related matters, she has a wealth of experience in traditional and disruptive technologies that support today's digital economy. She has advised some of the world’s biggest social media, software and technology companies and has successfully handled a wide range of the most relevant data privacy cases in Colombia.

Since 2019, she is certified by the EU General Data Protection Regulation (GDPRP), a qualification granted by the International IT Governance Qualifications Board.

Experience

Confidential Client: Legal advice on the implementation of a privacy notice for a technology company. This included creating, reviewing, drafting, and launching privacy documents in several Latin American countries, ensuring compliance with local regulations. The project was coordinated from Colombia, consolidating responses for the client.

Confidential Client: Comprehensive regulatory analysis for the launch of a new streaming platform in Colombia, including the assessment of cookie usage as a mechanism for processing information.

Confidential Client: Ongoing advisory services through a secondment arrangement, covering contract review, privacy, intellectual property, and AI regulation, among other aspects.

International social media company: Advising our client in the implementation of a Data Protection program that fulfills the local regulations, including the obligations for the Controller of personal data according to the Colombian Data Protection Law

Multinational software company: Advising our client on the response of a request for information performed by the Data Protection Authority. In this sense, we provided legal support and guidance to our client in the treatment of personal data of underaged population.

International streaming platform: Reviewed our client’s privacy policy and the advertising campaign that the company would use to implement a new streaming application and platform in Colombia, from the point of data and consumer protection.

Colombian financial institution: Advised and represented our client against the Data Protection Authority (DPA) in a case regarding the non-accomplishment of local requirements for personal data protection. Our advise included the appeal of the initial decision and the filing of a motion to dismiss the DPA’s act. The DPA revoked its initial decision ignoring the fine of approximately USD$ 42.0000 originally imposed to our client.

Multinational and local companies: Permanent counseling to clients on their intellectual and industrial property portfolios, both in their selection and protection, including patents, copyrights, trademarks, consumer protection, promotional activities, warranties, advertisement, regulatory matters, entertainment, and privacy.

Multinational and local companies: Assists clients with the design of policies and mechanisms to enforce IP (globally and regionally), as this is a competitive tool for clients in the market.

Multinational and local companies: Assists clients on international commercial agreements, e-commerce terms/online consumer-facing sales terms, social media and mobile messaging platforms, privacy issues as well as on all consumer protection issues involving advertising, warranties, sweepstakes, etc.
