Jane Bello Burke is a recognized healthcare attorney and partner at Hodgson Russ, known for her work in regulatory, reimbursement, and compliance matters throughout New York State. With over three decades of experience, she provides strategic legal counsel to hospitals, long-term care facilities, physician groups, and home care agencies and assists them in addressing complex legal and operational challenges.
She guides clients through statutory and regulatory healthcare requirements, including program participation, licensure, and certification standards. Her work includes advising on laws governing healthcare providers and their financial arrangements, including the federal Stark Law and Anti-Kickback Statute, as well as their New York counterparts. She regularly represents healthcare providers in administrative proceedings before federal and state agencies, including the Centers for Medicare & Medicaid Services, the New York State Department of Health, and the Office of the Medicaid Inspector General, addressing issues related to surveys, audits, and reimbursement.
In one notable case, Jane helped a healthcare provider reverse a permanent Medicare billing suspension caused by technical reporting errors. Her advocacy led CMS to reinstate the client’s billing privileges, protecting hundreds of thousands of dollars in reimbursements and avoiding major disruption. In other cases, she has effectively challenged immediate jeopardy violations and persuaded auditors or their agencies to withdraw audit findings and rescind disallowances.
