Ms. Cui Haiyan is the Deputy Director of Brighteous Law Firm and a first-class lawyer who was awarded the title of “National Outstanding Lawyer” in 2021. She holds a Bachelor’s degree in International Economic Law from Fudan University and a Master’s degree in Economic Law from Zhejiang University. With 27 years of legal practice, she is a Standing Council Member of the All-China Lawyers Association (ACLA) and serves as Deputy Director of the ACLA Foreign Affairs Committee. Ms. Cui is also the Vice President of the Lawyers Association of Zhejiang, a member of the Ministry of Justice’s Thousand Foreign-Related Legal Talent Program, and the member of ACLA Leading Talents Pool for Foreign-related Lawyers. She is an arbitrator of the Beijing Arbitration Commission / Beijing International Arbitration Court, Shanghai International Economic and Trade Arbitration Commission / Shanghai International Arbitration Center, Hangzhou Arbitration Commission / Hangzhou Court of International Arbitration. In addition, she is the Vice Chairman of the Zhejiang Merchants Foreign-related Legal Service Center, the head of both the Zhejiang Provincial Legal Service Team for Foreign Trade and the “Belt and Road” Legal Service Team. Having received training in the UK, the US, and Spain, Ms. Cui is one of five Chinese lawyers appointed by ACLA to attend the International Bar Association (IBA) Annual Conference and has delivered speeches at the World Law Congress. She has also hosted panels at the Inter-Pacific Bar Association (IPBA) Shanghai Annual Meeting & Conference.
Ms. Cui’s practice areas include cross-border transactions, compliance, international arbitration, and foreign-related dispute resolution. She has assisted numerous Zhejiang-based enterprises in successfully resolving various foreign-related disputes through settlement, including cases accepted by courts in the US and Ireland. Among these, she led her team representing a central state-owned enterprise’s Zhejiang subsidiary in a RMB 700 million bank recourse lawsuit relating to a shipbuilding guarantee, including first-instance, second-instance, retrial first-instance, retrial second-instance, and arbitration at the China Maritime Arbitration Commission (CMAC). Over the course of four years, she ultimately helped the client achieve a comprehensive settlement. She has also represented a Zhejiang-based state-owned enterprise in an international arbitration initiated by a French enterprise at the Singapore International Arbitration Centre (SIAC) concerning joint venture agreement and distribution agreement disputes. Her work helped reverse the unfavorable situation for the client, securing a settlement compensation amounting to tens of millions of RMB. Additionally, she represented a Ningbo-based private company in a RMB 100 million dispute over the termination of a distribution agreement with a European listed enterprise. By simultaneously pursuing domestic litigation and arbitration proceedings, she helped the client obtain a settlement of nearly RMB 100 million.Furthermore, she represented a Zhejiang-based private group in a RMB 1 billion profit forecast compensation agreement dispute triggered by the Russia-Ukraine conflict,
