Ernesto focuses his practice on infrastructure development and administrative law, particularly on structuring, implementing, and modifying public-private partnership projects in their various forms (concessions, public-private partnership agreements, and service agreements), advising public and private sector clients to identify the most suitable scheme for implementing the project and ensuring an equitable distribution of the risks assumed by each sector.
Throughout the structuring process, Ernesto analyzes the legislation to identify the legal framework for developing the project, drafts the documents on which the project will be awarded and implemented, assists in obtaining the authorizations to tender the project, and accompanies the client throughout the contracting process until the execution of the corresponding contract or concession.
He has also participated in the financing of infrastructure projects, contributing his experience in the structuring process to identify whether the project was structured in accordance with applicable legislation and to negotiate with banks the most favorable and flexible terms and conditions for borrowers.
In addition, he has participated in the acquisition of infrastructure development companies, negotiating the terms and conditions of such acquisitions.
His key clients include the Ministry of Infrastructure, Communications and Transportation (SICT), the National Infrastructure Fund (FONADIN), and in the private sector, his clients include major players in the country’s principal infrastructure projects, such as Mota Engil México, Grupo INDI, Quiero casa among others.
