Career

Davine is an all-round litigator with an extensive track record in complex disputes, often with a technical or international angle. She was seconded to London magic circle firm Slaughter & May in 2018. She has over a decade of experience in advising clients and litigating on their behalf before Dutch courts and arbitral tribunals (ICC, NAI, LCIA, UNCITRAL, etc.). Davine handles commercial and corporate matters that are crucial to our clients, often relating to the financial sector, large transactions, or governance and stakeholder issues. Davine is also highly experienced in dealing with execution and enforcement proceedings, attachments and injunctions, litigation funding issues, and various types of discovery processes. In this work, Davine often works together with firms in other jurisdictions, such as the UK and US on our clients' global defence.

In addition, Davine heads De Brauw's Climate and Sustainability Group, which is a cross-expertise working group of lawyers from several practice areas. Davine is highly knowledgeable on ESG-regulation, such as the CSRD and CSDDD. In this context, Davine has specific expertise in climate transition planning from a mitigation and adaptation perspective and climate scenario application. She holds a UNEP FI Climate Risk certificate, regularly speaks and publishes on the topic of climate risk management, mitigation and adaptation, and contributes to the Oxford University Net Zero Regulation and Policy Hub and its Climate Monitor. Davine regularly advises our clients on sustainability and value chain management, and on reporting and related greenwashing risks, and trains the boards of our clients on these topics.

Davine's experience includes:

- Representing a Dutch bank in climate litigation.

- Defending United Group in Enterprise Chamber proceedings initiated by its indirect minority shareholder

- Representing various listed and non-listed clients in post-M&A disputes, including warranty claims and earn-outs.

-Defending former SNS REAAL in inquiry proceedings against investors VEB and others before the Dutch Enterprise Chamber following the SNS REAAL's nationalisation in 2013, and in ancillary proceedings.

-Defending a foreign investor in a takeover attempt launched by a co-investor on investments in the Venezuelan oil sector.

-Defending Sunweb in summary proceedings and emergency appeal, regarding the takeover of Corendon.

-Representing SeeCubic and investors in proceedings against a former business partner relating to the ownership of assets.

-Defending Rabobank in class actions about interest rate swaps, and in related individual actions.

-Representing GasTerra in several multi-million price-revision arbitrations against buyers under long- term gas sales agreements.

-Representing KMG on EUR 200 million post-M&A arbitration and follow-on proceedings against the heirs of a Romanian oligarch.
