Dan Moss is a restructuring partner with significant experience in complex U.S. and cross-border reorganizations, distressed acquisitions, chapter 15 recognition proceedings, and crypto-related matters. He represents debtors, creditors, and creditors’ committees in major corporate and municipal restructurings, and advises on avoidance litigation, fiduciary duty, and corporate governance issues.
Dan’s work includes serving as co-lead counsel to Diebold Nixdorf in its 71-day restructuring of more than $2.7 billion of funded debt, implemented through the first-ever dual proceeding under chapter 11 and the Dutch WHOA and the first-ever chapter 15 recognition of a WHOA proceeding and plan. He also was lead counsel to Spark Networks SE in its restructuring under Germany’s StaRUG, including the first-ever chapter 15 recognition of a StaRUG proceeding and plan. Dan also was co-lead counsel to Peabody Energy in its chapter 11 restructuring and co-lead counsel to the Official Committee of Unsecured Creditors in Toys “R” Us Property Company I. He also played a significant role in the City of Detroit’s chapter 9 case, the largest municipal restructuring in U.S. history.
Dan is a Fellow of the American College of Bankruptcy, an active member in both the International Insolvency Institute and INSOL International, and a frequent speaker and writer on cross-border restructuring and legislative developments.
