Conall Patton has a broad commercial practice, including energy, competition, banking and finance, jurisdiction/choice of law, civil fraud and international arbitration. He has substantial experience of acting without a leader. In Las Bambas (2019), he successfully appeared (with a junior) for Glencore in a 2-day appeal in the Court of Appeal concerning the interpretation of tax indemnities in a Share Purchase Agreement, having previously conducted the 5-day Commercial Court trial, including cross-examination of fact and expert witnesses. Conall also has substantial experience of working with a leader as part of a larger team, including responsibility for oral advocacy. In Marathon Oil (2018), Conall’s cross-examination of the main audit witness was praised in the judgment for its “accuracy and concision”. In complex, multi-party Financial List litigation arising out of Tesco’s historic profit overstatement, Conall acted as the oral advocate for Tesco at five substantial interlocutory hearings. Conall has also acted in recent years for HP in a $5 billion fraud claim, for a Turkish bank in challenging jurisdiction, for a windfarm developer in a Force Majeure arbitration, and for British Airways and MAN in defending competition damages actions.
