Career

Carlos has specialised in Information Technology Law since 1992 and has more than thirty years of experience advising public and private entities, both nationally and internationally, across all areas of his field. His aim has always been to ensure that the law is never an obstacle for his clients, but rather an effective and practical tool that enables them to achieve their objectives while ensuring full compliance with their obligations.

Over the years, he has developed a particular interest in intellectual property, technology procurement and data protection. He also has extensive experience across various technology-driven sectors, including e-commerce, pharmaceuticals, NGOs and private non-profit foundations, as well as significant experience advising insurance companies, retailers and public administrations.

His expertise has enabled him to participate in several legislative initiatives in Spain in the fields of intellectual property and data protection. He advised on the drafting of the Software Legal Protection Act (1993), the Criminal Code reforms on computer crimes (1995), and the bills implementing the Copyright and Enforcement Directives (2002–2006), as well as the drafts of the Organic Data Protection Law (1998 and 1999). He also assisted in the drafting of the Law on Information Society Services (2000–2002) and the implementing regulations of the LOPD (2005–2007), contributing to the development of key security mechanisms.

He has authored numerous articles, including the Qualified Law on Personal Data Protection of the Principality of Andorra (2003–2004), and is currently working with the Government of Andorra on the drafting of its Electronic Signature Law.

Since 1992, he has served as legal advisor and lead counsel in Spain for BSA – The Software Alliance, which has allowed him to acquire extensive procedural and pre-litigation experience in prosecuting software intellectual property infringements. This work has also involved lobbying before the Spanish Government and regional and local authorities in defence of software companies’ IP rights and collaborating on legislative initiatives in the field of software intellectual property.

He has provided training to the Guardia Civil and the National Police on software intellectual property, software piracy and investigative techniques. He has also advised one of the first banks in Spain on the drafting of its Binding Corporate Rules for international data transfers within its multinational group.

He has spoken at more than 200 conferences at universities, bar associations, business associations and technology forums. He currently lectures on Master’s, postgraduate and specialised programmes in his field at ESADE (since 2004), ISDE (since 2015), the Barcelona Bar Association (since 2014), and previously at the University of Barcelona – IL3 (2013–2016) and the University of Alicante – Magister Lucentinus (1994–1996 and 2017–present).
