Work Highlights

Recent and current instructions include:

• Frasers Group Plc v Morgan Stanley & Co International Plc (2024) - For Morgan Stanley. The Commercial Court proceedings brought by the British retailer group (formerly Sports Direct) centred on economic torts said to arise out of a $900 million odd margin call in respect of options in Hugo Boss AG.

• LLC Eurochem North-West-2 -v- Société Générale & ING Bank [2023] EWHC 2720 (Comm) - Representing ING in EU sanctions-related proceedings brought by Eurochem for payment pursuant to performance bonds issued in connection with a project for the design and construction of a fertiliser plant in Russia. Trial is due to take place in 2025.

• PIFSS v Al Rajaan & Ors - Representing a Swiss bank (EFG Bank S.A) in proceedings brought by the Kuwaiti Public Institution for Social Security to recover sums alleged to have been misappropriated by its former director general. Trial of the action is due to commence in 2025.

• Dolphin Capital Partners Ltd v DCI Advisors Ltd [2024] EWHC 678 (Comm) - For the Claimant, Dolphin Capital Partners Limited, in a dispute concerning the termination of an investment management agreement.

• In the Matter of iKang Healthcare Group, Inc (Grand Court, 21 June 2023) - For the Petitioner, seeking a fair value appraisal pursuant to section 238 of the Companies Law (2013 Revision) in the Grand Court of the Cayman Islands against the backdrop of a going private transaction in 2018. Judgment on interested handed down 11 September 2024

Notable past cases include: Cavendish Square Holding BV & Anr v. Talal El Makdessi [2015] UKSC 67 (penalty clauses); Al Khorafi & Ors v Bank Safra Sarasin-Alpen (ME) Ltd & Anr [2018] DIFC CA 010 (Henderson abuse); Donohue v. Armco Inc & Ors [2002] 1 Lloyds Rep 425 (anti-suit injunctions to enforce exclusive jurisdiction agreements).
