Brandon Kain

Brandon Kain is a partner in the Litigation Group of McCarthy Tétrault LLP in Toronto, where he is the head and co-founder of its National Appellate Litigation Group. His practice focuses on appellate litigation, commercial disputes, regulatory law and class actions. He has acted in over 60 appeals, including 29 appeals in the Supreme Court of Canada, where he has successfully as lead counsel for the appellant, along with numerous appeals in the Federal and provincial appellate courts. His cases have included over 10 appeals from the CRTC to the Federal Court of Appeal, including as lead counsel, along with the judicial review of a Cabinet decision in the Federal Court.

Author of the two-volume text, Good Faith in Canadian Contract Law, published in October, 2024 by LexisNexis Canada Inc., awarded the 2025 Walter Owen Book Prize (first place) by the Canadian Foundation for Legal Research. Published over 20 articles in legal journals, including the Advocates’ Quarterly, Alberta Law Review, Annual Review of Civil Litigation, Banking and Finance Law Review, Canadian Bar Review, Canadian Business Law Journal and Supreme Court Law Review, which have been cited in numerous judicial decisions, including by the Supreme Court of Canada and the United Kingdom Supreme Court.
