Practice Areas
Principal areas of practice are construction, including claims against construction professionals and professional negligence. Frequently involved in cases involving architects, engineers, surveyors and project managers. Subject matter of disputes in which Ben is involved range from failing floors to deficient M&E systems and types of projects range from large residential developments to airports. Considerable recent experience in cladding litigation. Particular expertise in CAR and professional indemnity insurance. Appears in the TCC and higher courts as well as in domestic and international arbitrations and in adjudications. Other areas of professional indemnity work include cases involving solicitors, barristers, accountants, financial advisers and insurance brokers. Also, substantial experience in commercial and insurance disputes. Leading cases include Dreamvar UK Ltd v Mishcon de Reya, Hunt v Optima, Biffa Waste Services Ltd v Maschinenfabrik Ernst Hese Gmbh. Acts as an arbitrator, as a mediator and as an adjudicator.
Career
Called to the Bar in 1986. King's Counsel 2010. Called to Bar of the Republic of Ireland in 1998, called to Bar of Northern Ireland in 2014.
