Firm Overview:
Whether a multinational corporation, an investment fund, a local start-up, or international NGO, Paz Horowitz Abogados delivers the legal power and understanding needed to fulfill clients’ goals. For Paz Horowitz and its clients, this means, ‘doing well by doing it right’.

The firm focuses on quality rather than size to build its team, and when it comes to accepting new clients, it focuses on their business ethics and corporate responsibility.

Founded in 1991, Paz Horowitz delivers practical, ethical and cost-effective legal services. Its lawyers consistently receive recommendations from its clients, commercial chambers, embassies as well as from Chambers and Partners, IFLR, Legal 500, Latin Lawyer, Leaders League, among others.

Paz Horowitz was the first law firm in Ecuador to sign the UN Women’s Empowerment Principles and to join the UN Global Compact. Also, the firm was recommended in Ecuador for The Latin America Corporate Counsel Association in Compliance and Anti-Corruption.

Main Areas of Practice:

Corporate/Commercial /M&A/Immigration:
Paz Horowitz is well recognised for its extensive experience and knowledge in M&A and commercial transactions. Its team is formed by partners Jorge Paz Durini, Juan Carlos Pérez, Rocío Córdova, David Benalcázar, Cesar Molina and Agustín Acosta Cárdenas, each providing legal advice to clients in sectors such as aviation, real estate, floriculture, pharmaceutical, telecommunications, energy, oil and mining, importation and distribution of automobiles and tourism.

Intellectual Property:
Paz Horowitz is well-known for its extensive experience and knowledge in M&A transactions. Its team is formed by Jorge Paz Durini, Juan Carlos Pérez, Rocío Córdova, David Benalcázar, and Agustín Acosta Cárdenas, María del Mar Heredia and Gabriel Santelices, each providing legal advice to clients in sectors such as aviation, real estate, floriculture, distribution companies, pharmaceutical, telecommunications, energy, oil and mining, importation and distribution of automobiles. This department is best known for its hands-on advice and participation in the transactions they are involved, because its partners (not only associates) get deep into the documents, details and document preparation. The corporate team works side by side with its tax and accounting team to find viable solutions to issues that otherwise could be deal breakers.

Intellectual Property:
The IP team produces creative and cutting-edge legal and consulting work, principally focused in technology transfer, recognising, protecting and negotiating IP assets, and trademark applications and trademark rights. Byron Robayo, who leads the IP team, has advised to the World Intellectual Property Organization (WIPO) and the Ecuadorian IP Office. Paz Horowitz was the first legal firm in the region that created an area specialised in innovation and technology transfer: PH Innovations, that advises and supports corporations to develop products with high added value using cutting edge technology. As it is an innovative service, the advice requires a clear and detailed explanation of the patent system and technology transfer locally and internationally.

Tax & Accounting:
Paz Horowitz advises in tax compliance, audit requirements, complex tax transactions and tax litigation before the Ecuadorian IRS and courts. With the incorporation of Lorena Vivanco (financial expert) and Agustín Acosta Cardenas (Partner who handles corporate matters and investments contracts) to the team, the tax department has now changed its name to become tax and project finance, with the idea to retain clients from the moment they do an economical valuation and financial analysis of possible companies they are interested in acquiring or mergering, rather than just assisting on the legal matters of an M&A once the economic valuation and financial analysis are done. Its specialised team led by Jorge Paz Durini in collaboration of Sara Romero and Gabriela Cueva provides accounting, audit and transactional support.

Energy & Natural Resources:
Paz Horowitz is one of Ecuador’s leading law firms in energy and natural resources. Led by Jorge Paz Durini, a great negotiator and excellent in oil, mining and international contracts’ (as reported by Latin Lawyer 250), Juan Carlos Pérez, Rocio Córdova and Maria del Mar Heredia, clients say they come to Paz Horowitz for its broad experience in the natural resources and energy sector. The oil and gas team represent some of the largest investment ventures in Ecuador and participates in various renewable energy projects.

Labour & Employment:
This practice area has taken a drastic change from previous years, delivering preventative advice in order to reduce lawsuit and administrative claims to the minimum. Nevertheless, when disputes arise the team has over 90% of success rate in its trial cases. Patricia Andrade, head of labour and employment department, is a social security and labour law expert, who offers her clients a complete consulting experience because of her deep knowledge, ability to negotiate, and ability to explain the risk and solutions, which places the firm above all other firms. Senior Associate Xavier Montesdeoca is praised for his immigration services to the firm's multinationals clients.

Dispute Resolution & Litigation:
Paz Horowitz has represented both national and foreign companies in legal claims of different kinds, such as civil, administrative and judicial proceedings, and constitutional claims. In 2019 the firm decided to hire two lawyers to strength and increase its litigation and conflict resolution team. David Garcia who has 14 years of experience in administrative law and public procurement, having worked at the Attorney General Office and other Government institutions (now on temporary license as Innovation Director in the Judicial Funcial), and Leyre Suarez recognised by Chambers & Partners as Associate to watch in dispute resolutions due to her expertise in litigation and international arbitration.

Anti-Corruption/FCPA Compliance:
Licensed to practice law in the USA and Ecuador, Bruce Horowitz provides seminars and training courses on compliance with the US FCPA and other anti-corruption laws, and helps clients (along with anti-money Laundering expert Catalina Carpio) to use ethical negotiation principles and ‘positive deviance’ approaches to get what rightfully belongs to the clients in extortion situations. Agustín Acosta Cárdenas (technical secretary of the International Chamber of Commerce of Ecuador’s Integrity and Anticorruption Commission) Maria Elisa Holmes and Esteban Vivero, reinforce the compliance team with extensive knowledge in compliance, anticorruption and ISO 37001 and 19600.

Real Estate:
The team led by Veronica Mieles and Jorge Paz is one of the few law firms that provides a combined service to real estate clients including tax planning, project finance, accounting structure and forecast of future results.

Competition Law & International Trade Law:
Led by Eduardo Esparza, this area provides comprehensive legal and economic services on issues of competition law and international trade law, in order to facilitate the participation of its clients on global markets.
