Sam is a seasoned litigator who has dedicated his career to representing life insurers in high-stakes disputes and advising on complex regulatory matters. He has played a pivotal role in defending insurers in some of their most consequential litigation, securing significant victories at the class certification and summary judgment stages.
His experience includes representing clients in class actions arising from the sales and marketing of fixed index annuities, including claims brought under the Racketeer Influenced and Corrupt Organizations Act, state unfair competition and business practices statutes, and common-law fraud. He has also defended life insurers in breach of contract class actions involving cost of insurance provisions in universal life and interest-sensitive whole life policies, helping to obtain favorable rulings denying class certification and granting summary judgment.
More recently, Sam’s practice has focused on defending clients in the evolving wave of life insurance class actions targeting the sales and marketing of proprietary market indices associated with fixed index annuities and index universal life products.
In addition, Sam has extensive experience handling a broad range of insurance disputes, including matters involving lapse notices, interest adjustment and market value adjustment provisions, interest crediting methodologies, and alleged violations of state insurance regulations. He has also represented insurers and reinsurers in reinsurance arbitrations and continues to advise life insurers on emerging regulatory developments.
