Practice Areas

Focused on contentious antitrust matters, Niki is routinely retained by Canadian and multinational clients facing high-stakes, competition issues, including mergers, cartels, abuses of dominance, false and misleading advertising claims, and class actions. Recent matters involve investigations into social media, food delivery, alleged abuse of dominance in commercial aviation; alleged misleading online price representations in intercity transportation and temporary accommodations; e-Book publishing; airline joint ventures; and class actions regarding salmon, hard drive suspension systems, sub-sovereign bonds, and generic drugs.

Career

Ontario Bar, 2004.

From 2009 to 2012, counsel to Canada’s Commissioner of Competition, providing clients with unique insight and deep understanding of how the Competition Bureau operates. Led numerous cases before Competition Tribunal, including lead lawyer for Kobo in e-Books, obtaining the first-ever order enjoining the Commissioner from implementing a consent agreement and the first-ever contested order rescinding a Consent Agreement.

Chair: Competition Litigation Committee of the CBA Competition Law Section.

Co-Chair: ABA Section of International Law’s International Antitrust Committee.

Editor, Litigating Competition Law in Canada (LexisNexis Canada, 2018), Canada’s first textbook on competition litigation.

Co-author, with former Supreme Court of Canada Judge the Hon. Thomas Cromwell and Bryan Finlay QC, of Witness Preparation: A Practical Guide (Thomson Reuters, 2018), 4th edition.
