Wang Jing has represented numerous dispute cases over construction project contracts and possesses the capability to handle legal matters in the field of major and complex construction disputes. She has extensive experience and a deep understanding of construction dispute practices, including litigation procedures, litigation review points and related legal issues, local commercial transaction litigation concepts, judicial decision standards, and litigation rules.
For example, Wang Jing represented Guangzhou Construction Research Institute Co., Ltd. in a contract dispute case against China Railway Bureau Group Guangzhou Engineering Co., Ltd. and China Railway Bureau Group Co., Ltd. In this case, our client and the opposing party completed 12 settlement procedures regarding the procurement of steel, but the opposing party still owed more than 10 million yuan, leading to a dispute. The case faced major challenges: first, the penalty clause in the contract stated that the total penalty would not exceed 1% of the amount due. Could this cap be challenged? Should the court strictly respect the parties' autonomy, or could the judiciary intervene in this unequal provision? Second, the case involved a large sum, and our client emphasized the importance of receiving part of the payment before the Lunar New Year. Given the common difficulty in enforcing judgments, would it be possible to collect the payment before the Lunar New Year?From the initial filing in the first instance, the agent verified the factual issue regarding a single shareholder during the debt period and immediately applied to the court to add the defendant, implementing asset preservation on the shareholder’s parent company. The parent company's account was effectively frozen with cash, laying a solid foundation for enforcement. Regarding the penalty clause of "total not exceeding 1% of the overdue payment," the agent conducted extensive case research to understand judicial opinions, and during the second instance, rigorously argued the defense to protect our client’s rights. Ultimately, after applying for enforcement, the client successfully received the full payment of 10 million yuan in cash on the 26th day of the last lunar month. The funds were smoothly distributed, including wages for migrant workers, employee salaries, and settlement with material suppliers, which was no small achievement.
