Vicky Chen is an Employee Retirement Income Security Act (ERISA) and employee benefits lawyer with extensive experience in qualified plan design, administration, and compliance, specifically with respect to 401(k) plans.
Vicky advises a broad range of public and private clients on their employee benefits-related matters. She assists clients in amending and restating qualified retirement plan documents, including policies and procedures; preparing related employee notices and communications, such as summary plan descriptions and annual required notices; merging, spinning off, or terminating retirement plans; filing determination letter applications with the Internal Revenue Service (IRS); responding to IRS and U.S. Department of Labor (DOL) audits; and advising on all aspects of plan administration. She also assists with correcting plan failures under the IRS' Employee Plans Compliance Resolution System (EPCRS) and the DOL's Voluntary Fiduciary Correction Program (VFCP) and Delinquent Filer Voluntary Correction Program (DFVCP). In addition, Vicky advises on employee benefits issues in mergers and acquisitions, as well as on retirement plans for nonprofit and government entities (457(b) and 403(b) plans).
Fiduciary governance practices are a common concern of Vicky's clients, and she routinely attends clients' 401(k) committee meetings and advises on related issues.
