Gus Baker’s practice focuses on employment, pensions, commercial litigation (including arbitration) and professional negligence disputes.

Gus’ employment expertise covers commercial employee competition, business protection disputes, whistleblowing and discrimination claims. He also conducts internal investigations and advises organisations on disciplinary actions.

Recent cases include; Glover v Lacoste UK Limited [2023], leading case on the application of PCPs in maternity discrimination; representing a Premier League football club against allegations of race discrimination; and AB v A Private Equity Company [2023], allegations of sexual assault, discrimination and harassment.

Gus is also an experienced pensions barrister, frequently instructed in significant claims of high-value and sensitivity. Recent cases include acting for a representative beneficiary in a large Part 8 Claim; advising (unled) employers of a scheme in relation to various mistakes in historic deeds; and bringing and resisting claims on behalf of scheme members in connection with negligent mistakes.

He was part of the counsel team instructed on behalf of the claimants in a five-week, high-value, multi-party professional negligence claim arising out of the decision of Newey J in Gleeds Retirement Benefits Scheme.

Gus has a broad commercial disputes practice, often with an international dimension. He is regularly instructed on multi-million-pound international arbitration matters with experience under the LCIA and UNCITRAL rules. He has helped to draft legislation in the Middle East; was instructed in the insolvency of Hatfield Colliery; and he was part of the counsel team for Grant Thornton in multi-million-pound conspiracy claims brought by Robert Tchenguiz in the Commercial Court.
