Eleanor advises on a range of contentious and non-contentious workplace issues for partners, LLP members, senior executives, companies, LLPs and professional partnerships. She has a keen interest in issues involving disciplinary procedures as well as restrictive covenants. Eleanor has experience litigating in the Employment Tribunal and High Court in addition to dispute resolution through the forums of mediation and arbitration. Eleanor has broad experience drafting and advising on various types of employment and partnership documentation, including partnership deeds, service agreements, employment contracts, and settlement agreements. Eleanor advises clients in a range of settings, with particular experience in fund management and law firms.

Career

Eleanor joined Fox & Partners in 2019, having trained at Slaughter and May and worked in their Pensions, Employment and Incentives team on qualification.

Eleanor is a member of the Industrial Law Society and the Employment Lawyers Association.

Publications

Eleanor has contributed to the Lexology GTDT Market Intelligence on Labour & Employment in addition to writing articles for the Law Society Gazette and Employment Law Journal. She has also appeared on ‘Foxed’, the firm’s podcast, discussing issues relating to partner transitions. She has also appeared on a panel for Fox’s Breakfast Briefing, a practical seminar series, discussing internal investigations into partner misconduct at law firms.

Personal

Eleanor is a governor at a local state primary school and a listening volunteer at the LGBT+ charity Switchboard.

Work Highlights

• Providing legal and strategic advice to a partner in relation to potential claims in response to threatened de-equitisation and reduced profit share, and assisting in negotiations to achieve the client’s objectives of leaving the firm with a financial package and time to consider her future. Potential claims included indirect sex discrimination linked to contribution assessment and an equal pay claim.

• Advising on the successful incorporation of a multi-office trademark and patent firm and the transfer of its partnership business to an LLP.

• Acting for a senior executive to protect valuable carried interest rights on exit; manage the interplay with foreign law governed incentive documentation and navigate post-termination restrictions.

• Acting for a senior executive in relation to potential claims arising from whistleblowing to the FCA; sickness absence and redundancy. The matter involved working alongside specialist regulatory counsel.

• Advised on the appointment of a senior executive including negotiating his Service Agreement and a Side Letter in relation to an award of sweet equity.

• Advising in relation to claims brought against an unincorporated association employer by the estate of the deceased Executive in relation to a death in service benefit and other statutory employment claims.
