Tobias has provided investigative support in international litigation and arbitration across CEE, Russia/CIS, MENA, Sub-Saharan Africa, North America as well as offshore jurisdictions in Europe, the Caribbean and Asia for the last decade.
Evidence gathered by Tobias has been submitted to the High Court of England and Wales; US federal courts in New York, Florida and other US states; European courts, including Guernsey, Germany, France and Cyprus; and arbitral tribunals constituted under the rules of ICSID, LCIA, ICC and other regional arbitration centres; in support of worldwide freezing orders, Norwich Pharmacal applications, section 1782 applications, civil fraud proceedings, and RICO complaints.
Tobias’ clients include both states and investors in contractual and treaty investment arbitrations, corporations and sovereign wealth funds, and UHNWI. His matters range across diverse geographies and industries, including private credit and private equity, energy and mining, renewable energy, real estate and healthcare.
• investigative support of a EUR 1 billion ICC private-credit arbitration on behalf of a Middle Eastern sovereign wealth fund against a Central European real estate conglomerate, including ancillary proceedings in the Guernsey courts in support of Norwich Pharmacal relief and a worldwide freeze order;
• various EUR 100 million+ post-M&A arbitrations both on behalf of the buyers and sellers of portfolio companies in the healthcare and tech sectors;
• an investigation into the asset position of a banker based in the UK in support of insolvency proceedings in the UK and ancillary Chapter 15 proceedings in the US, resulting in a worldwide freezing order in excess of GBP 700 million and disclosure orders in the BVI, Cyprus and other offshore jurisdictions;
• working on behalf of a European state in a multi-billion US dollar PCA arbitration in support of jurisdictional defences and application for bifurcation;
• an investigation into corruption at a CIS state-owned company and potential collusion between government officials in support of a multi-billion ICSID investment arbitration;
• advisory in the context and global coordination of the enforcement of a USD 200 million judgment against a private individual in Canada, the US and various European jurisdictions; and
• tracing the assets of a sovereign European state for the enforcement of an anticipated multi-billion US dollar arbitral award for a mining investor and many others.
In addition to casework, Tobias' background in European and Public Law helps him in providing consultancy and intelligence services in relation to the US, UK and EU sanctions regimes.
Tobias regularly contributes to panels on international arbitration, sanctions, asset recovery and enforcement strategies, investigative support of legal proceedings, and reputation management. In recent years, he has spoken at London International Disputes Week, Paris Arbitration Week, ICC events, the International Forum of Seniro Executive Advisers, the Berlin Dispute Resolution Days, and events organised by DIS, VIAC, ASA and other regional arbitration associations.
A native German speaker, Tobias is fluent in Russian and speaks conversational Ukrainian and French. He has lived and worked in Germany, Russia and Kyrgyzstan.
