Simon is a private client lawyer who litigates, with extensive experience spanning a range of contentious matters, notably onshore and offshore trusts disputes, and non-contentious estate planning solutions.

He focuses on disputes involving trusts, wills and estates, commercial disputes including fraud, partnership and minority shareholder actions, tax litigation, misrepresentation, fraud and areas of marital law such as pre- and post-nuptial agreements.

Simon has considerable experience in advising on corporate transactions, wealth planning and trust matters for a wide range of clients, which include individuals, trustees, beneficiaries, protectors, charities and corporate entities. He also administered a UK trust corporation for a number of years, as well as holding various non-Exec director roles and has acted as in-house counsel providing primarily commercial contracts advice.

Simon is the co-founder of ConTrA (the Contentious Trusts Association), which he co-founded in 2015 and is now the leading Contentious Trusts organisation with around 1,000 members. He also chairs the TransTrusts annual conference, which is one of the foremost Private Wealth Disputes conferences.

Simon is a CEDR accredited mediator.

Career

Having read law at Manchester University, Simon trained and qualified at Berwin Leighton Paisner (latterly Bryan Cave Leighton Paisner) before joining Maurice Turnor Gardner and becoming a partner in 2020. Simon moved to Fladgate in January 2024.

Professional Memberships

Simon is a co-founder of ConTrA (the Contentious Trusts Association) and a member of The Society of Trust and Estate Practitioners (STEP).

Work Highlights

Salem and M. Salem v Sequent (C.I.) Limited & ors [2024] GCA064 successfully advising in the Guernsey Court of Appeal, involving an attempt by trust companies in the Sequent group seeking the recusal of the Bailiff from hearing a breach of trust claim and dealing with the Court’s view that privacy orders will not necessarily be applied to appeals from in private proceedings.

Al Thani & Anor v Al Thani & Ors [2024] UKPC 35 successfully defended an appeal before the Privy Council from the BVI Courts regarding the ruling family in Qatar on a point of law regarding the situs of shares and whether shares in BVI companies should be treated as immovable assets for succession purposes.
