Practice Areas

Saira’s practice covers all aspects of planning and environmental law, local government, highways, compulsory purchase, Transport and Works Orders and parliamentary. She regularly appears in the Court of Appeal, High Court, Public Inquiries and the Crown and Magistrates Courts in a wide range of proceedings. She also regularly advises and appears at hearings in relation to Community Infrastructure Levy Regulations issues.

She has recently acted for Westminster City Council in a series of High Court and Court of Appeal cases concerning the correct interpretation of permitted development rights for telephone kiosks and advertisements, the proper approach to a mixed hotel and hostel use and in various planning and enforcement appeals in respect of viability and affordable housing contributions. She is presently acting for numerous developers in London and South East in respect of hotel and shared living developments. Recent local plan examination work includes promoting the Central Bedfordshire Local Plan and making representations in respect of several others including the South Oxfordshire Local Plan. She has recently been acting on behalf of numerous developers in respect of their representations to emerging local plans in London and the South East. She has also appeared at the East West Rail Inquiry and been advising in respect of the proposed M1/A6 link road and associated judicial review challenge. Other recent work includes appearing for the developer in a significant High Court case relating to the meaning of public benefits in the context of harm to heritage assets. She has also appeared in the Court of Appeal upholding the grant of permission by Central Bedfordshire Council for a major urban extension, Oxford Diocesan Board of Finance v Secretary of State for Communities and Local Government Court of Appeal dealing with discretion and ministerial policy and R. (on the application of Peel Land and Property Investments Plc) v Hyndburn BC, Court of Appeal concerning material changes of use, retail parks and the interpretation of permissions) Planning inquiries include a recent Wokingham housing and infrastructure planning inquiry, Esbies green belt inquiry, Hertfordshire, SITA landfill inquiry, Cumbria; Parliamentary: Crossrail; Special Parliamentary Procedure, Transport and Works Act: Victoria Station upgrade (an upgrade involving new platform and infrastructure works) and other Crossrail related inquiries.
