Ross Siler

Practice Areas

Ross Siler focuses his practice on representing hospitals, laboratories, and healthcare clients in litigation and regulatory matters, as well as government investigations and consumer protection cases. He has represented clients in several large-scale investigations and suits brought by the Washington Attorney General's Office and U.S. Attorney's Office, and has led efforts to respond to civil investigative demands and government subpoenas.

In recent years, Ross has defeated class certification and obtained an order striking class allegations on behalf of a regional hospital system, obtained dismissal with prejudice of claims challenging an employee COVID-19 vaccination policy for a national healthcare system, and obtained dismissal of claims on judicial estoppel and other grounds for another regional hospital.

Ross was part of the team that defended the Value Village thrift store chain against the Washington AG through years-long litigation and appeals. Ross examined multiple witnesses during the three-week trial, including the State's investigator. The defense prevailed on the majority of claims at trial and denied the State's attempt to recover unprecedented nationwide monetary relief under the Washington Consumer Protection Act.

The Washington Court of Appeals subsequently dismissed all remaining claims in the case on First Amendment grounds in August 2021 and the Washington Supreme Court affirmed dismissal in a 9-0 decision in February 2023. Ross contributed to every stage of appellate briefing. Value Village ultimately recovered nearly $4.3 million in attorneys' fees and costs—the largest-ever fee award against the Washington AG.

Ross has briefed and argued Rule 12, summary judgment, discovery, and pretrial motions in Washington courts; drafted appeal briefs and mediation submissions; deposed government representatives; prepared and defended corporate executives in depositions; and coordinated document review and production projects.

Ross is currently representing hospitals in class action suits related to patient care issues. He also has represented and advised hospital and laboratory clients in payor and other disputes, including matters related to COVID-19 testing. He has advised hospital and healthcare clients on Washington's coordinated quality improvement privilege and the development of their QI programs. Ross additionally has presented on topics at meetings of the Washington State Society of Healthcare Attorneys and regularly presents to clients on fraud and abuse issues and other topics.

Before law school, Ross worked at newspapers in California and Utah and brings his reporter's background, writing skills, and instincts to his work as a lawyer.
